This section applies to the information that BTA Group LLC collects from all users for its own operational purposes.

1. Personal Data Collected by BTA Group LLC

– Contact and Account Information: Name, email address, phone number, address, and payment details when an account is created or services are engaged.

– Usage and Device Data: IP address, browser type, operating system, and pages visited when interacting with the BTA Group LLC website.

2. How BTA Group LLC Uses Your Personal Data

– To Provide Services: To process transactions, manage your account, and provide customer support.

– For Marketing: To send promotional materials and updates, from which you may unsubscribe at any time.

– For Legal Compliance: To comply with legal obligations and enforce the policies of BTA Group LLC.

3. How BTA Group LLC Shares Your Personal Data

– BTA Group LLC may share your information with service providers that assist in its operations (e.g., payment processors) or when required by law. BTA Group LLC will never sell your Personal Data.

4. Your Rights Regarding Your Personal Data You have the right to request access to, correction of, or deletion of the personal data that BTA Group LLC maintains about you, subject to the obligations and retention policies detailed in Part III of this document.

This section applies specifically to clients who have engaged recurring services from BTA Group LLC.

5. BTA Group LLC’s Role as a Data Processor: When providing accounting and administrative services, BTA Group LLC acts as a “Data Processor” on behalf of your company, which is the “Data Controller.” This means that BTA Group LLC handles your data based on your instructions and the terms of the service agreement.

6. Use of Customer Data BTA Group LLC will access and process Customer Data solely and exclusively for the purpose of:

– Delivering the contracted services (e.g., accounting, payroll, tax return preparation).

– Preventing or addressing technical or security issues.

– Complying with the Client’s documented instructions.

BTA Group LLC will never use Customer Data for its own purposes, such as marketing or product development unrelated to the contractual relationship.

7. Security Measures for Customer Data

BTA Group LLC implements technical and organizational security measures, including encryption of data in transit and at rest, access controls based on the principle of least privilege, and periodic security assessments.

8. Data Breach Notification In the event of a security breach affecting Customer Data, BTA Group LLC will notify affected clients without undue delay, providing details of the incident and the steps being taken to mitigate it.

9. Deletion of Customer Data Upon Termination of Services Upon termination of a Service Agreement, BTA Group LLC will securely delete or return all Customer Data in its possession within a period of 60 days, unless retention is required by law (such as tax records required by Hacienda or the IRS).

10. Data Retention for Legal and Financial Purposes Notwithstanding any other provision of this policy, BTA Group LLC will retain certain information (including Personal Data and Customer Data) for extended periods if necessary to comply with legal, tax, or regulatory obligations in Puerto Rico, resolve disputes, or enforce agreements. For example, records of financial transactions will be retained as required by applicable tax laws.

11. Changes to This Privacy Policy

BTA Group LLC may update this policy periodically. Changes will be posted on the BTA Group LLC website. For material changes affecting the processing of Customer Data, BTA Group LLC will send direct notice by email.
